The Guardianship Board
The Guardianship Board is a court-like tribunal that has the power to make important decisions affecting the lives and property of people over whom it has jurisdiction as set out in the Guardianship and Administration Act and Mental Health Act.
If a person is suffering mental incapacity and there is a need to appoint someone to make important decisions about medical treatment, where a person lives or lifestyle issues, then the Guardianship Board can appoint a Guardian. An Administrator may also need to be appointed to look after a person’s financial and legal affairs.
The Guardianship Board also considers applications under the Mental Health Act including detention and treatment in hospital and/or compulsory treatment for a person’s mental illness in the community.
The Guardianship Board conducts its business by way of a semi-formal hearing. Orders made by the Guardianship Board are legally enforced.
