Draft Legal Profession Bill 2006 (SA) - Release for Public Consultation
Comments are invited on the draft Legal Profession Bill 2006 (SA) preparatory to its planned introduction into Parliament in early 2007.
The draft Bill is based on the National Model Laws adopted by the Standing Committee of Attorney-General's in July 2006 (as the national model laws are a work in progress, the latest version of the model can be found on the website of the Law Council of Australia at www.lawcouncil.asn.au, together with other helpful material, including draft model regulations).
The draft Bill adopts the core provisions of the national model, as the inter-governmental agreement requires. Where a provision is designated ‘core uniform’ in the model, it has generally been adopted word for word. Where it is designated ‘core non-uniform’ it has been adopted in substance, using the words advised by Parliamentary Counsel. Some non-core provisions have also been adopted, where they are judged useful. Drafting notes have been left in the draft Bill to indicate those model provisions upon which each provision of the draft Bill has been based.
South Australia is committed to the national model and the Government cannot accede to requests for a substantially different approach. The Government is also committed to the core-uniform clauses of the model more or less as they stand. Comment should therefore not take the form of alternative regulatory proposals or suggestions for substantial redrafting, but comment of any other kind will be valued.
