Native Title

South Australian Native Title Claim Resolution Team (in conjunction with Native Title Section), Crown Solicitor's Office

A number of native title claims have been lodged in the Federal Court. These claims cover about 70% of the state and automatically involve the state as first respondent. However, rather than press the matters to trial, the South Australian Government has a policy of seeking to negotiate settlements of the claims. Apart from being a more effective way of resolving the claims, the process of discussion and negotiation also develops positive, mutually beneficial, long term outcomes and relationships between the negotiating parties, which include peak bodies representing native title claim groups, the pastoral, mineral and resources industries, local government and commercial fishers.

Negotiations are conducted by a team of negotiators housed within Attorney-General's Department, who, in conjunction with the Chief Executive's Task Force on Native Title Claim Resolution and staff from the Native Title Section of the Crown Solicitor's Office, seek to resolve native title claims by agreement, with support from other relevant agencies across government.
