A new conduct management framework for council members in one of the major reforms for South Australia's local government sector.

Behavioural Standards Panel

One of the significant elements of the new council member conduct management framework is the Behavioural Standards Panel.

The Panel will deal with complaints about the behaviour of council members that cannot be resolved at the council level - particularly 'repeated' and 'serious' misbehaviour.

Only the council or specific persons from the council will be able to refer matters to the Panel.

The role of the Panel is outlined further under amendments made to the Local Government Act 1999.

Panel members

The three Panel members were appointed by the Governor on 17 February 2022 and are currently undertaking work to establish the Panel, including drafting guidance material and practice directions.

These will be prepared before the Panel can formally commence its role in November 2022.

Behavioural Standards

The Minister has approved a 'final draft' of the proposed Behavioural Standards for Council Members following a public consultation on YourSAy that ran from 20 December 2021 to 16 February 2022.

The Behavioural Standards will formally come into operation with the new council member conduct management framework, proposed to commence in November 2022 to coincide with a new term of councils.

The Behaviour Standards will replace Part 2 of the current Code of Conduct for Council Members.
