A significant number of sexual assaults never come to the attention of the criminal justice system. Of those offences that are reported, only a small proportion proceed to trial, with an even smaller percentage resulting in a successful conviction.
About the review
At the 2022 election, the government committed to a review of South Australia's sexual consent laws.
The Attorney-General's Department undertook this review, looking at consent laws across the country.
The resulting discussion paper has identified several areas that might benefit from reform, including:
- introducing an affirmative consent model
- changing the subject, timing and frequency of jury directions
- increasing penalties for image-based sexual offences.
