Tough new laws cracking down on street gangs and repeat young offenders have commenced this week.

The reforms give authorities additional, stronger powers to target and disrupt the activities of street gangs. The reforms also tighten the provisions targeted at youths who repeatedly commit serious offences, to better identify and manage repeat young offenders, with tougher sentences applying to them.

Under the new laws:

  • The Commissioner of Police can apply to the courts to see a group designated as a ‘declared street gang’, and seek control orders against
    gang members.
  • Individuals can be prosecuted for seeking to recruit street gang members, with more severe penalties for adults recruiting minors into street gangs
  • Anti-association laws will come into effect, similar to those that exist involving organised crime and outlaw motorcycle gang members
  • Courts will need to place greater priority on community safety when sentencing repeat young offenders
  • There will be a presumption against bail when considering applications from recidivist young offenders who are facing serious criminal charges.
